CONDITIONS OF SALE

APPLICATION OF GOODS Contracts and orders are accepted upon and subject to the conditions below. Unless expressly accepted in writing any qualifications of these conditions in any written or printed document of the customer shall be deemed to be inapplicable.

PAYMENT TERMS are thirty days from date of invoice. The Company reserves the right to withhold further dispatches to customers whose accounts are overdue

INTEREST PRICES The Company reserves the right to charge interest on overdue accounts.

PRICES are correct at the time of publication but are subject to alteration without prior notice.

PRODUCTS The company reserves the right to modify products without prior notice.

SAMPLES Notwithstanding that a sample of the goods may have been exhibited or shown to the buyer and inspected by the buyer, it is hereby declared that such samples are solely to enable the buyer to judge the quality or the type of goods and do not constitute a sale by sample under the contract. The buyer shall take the goods at his own risk as to their corresponding with the sample or as to their quality, condition or sufficiency for any purpose.

SCHEDULE ORDERS A scheduled order calling for delivery spread over a defined period shall constitute authority to manufacture and shall define the buyers ultimate delivery. The buyer is at all times liable for current total scheduled stocks and works in progress.

TITLE OF GOODS is only transferred when payment has been received for all amounts due and owing. Should amounts due be unpaid, Hamilton Gas Products Ltd shall have the right to enter the customer’s premises during ordinary business hours and take possession and remove such of its goods as are in the customer’s possession. If the goods have been sold by the customer before all payments have been made to Hamilton Gas Products Ltd, the customer must hold the proceeds arising from such a sale as trustee for Hamilton Gas Products Ltd until all payments due have been made. In the event of a customer being placed in Receivership or Liquidation it is not the intention of the parties hereto, that a Receiver or Liquidator be empowered to sell Hamilton Gas Products Ltd goods save where all payments due and owing to Hamilton Gas Products Ltd by the customer have been paid in full.

DELIVERY is normally next working day for Northern Ireland & the Republic of Ireland. Scotland,England & Wales 3-4 working days.

RETURNED GOODS which have been correctly supplied and are returned for credit, will only be credited less a 15% handling charge less carriage at cost. All items must be in a re-saleable condition and in their original packs.

FAULTY GOODS should be returned by the buyer to Hamilton Gas Products Ltd, at the buyers own expense, within 7 days of delivery. Such goods will not form the basis of any claim for work done or for any loss, damage or expense whatsoever arising directly or indirectly from such a claim. Goods must be accepted by Hamilton Gas Products Ltd as defective. Hamilton Gas Products Ltd reserves the option to repair goods, or to replace them with goods similar to those ordered. Where goods have a manufacturing fault the item must be labelled detailing the nature of the fault. This information is required by the manufacturers in order to credit Hamilton Gas Products Ltd. In some instances there may be a time delay in raising the credit, as the product may need to be checked by the manufacturers technical department, this is the case with all regulators.

WARRANTY All goods supplied by Hamilton Gas Products Ltd have a manufacturers warranty of 1 year from date of manufacture, to be free from defects in materials and workmanship under normal use and service with the following exceptions:

• Bullfinch 5 years from date of manufacture
• Royal Cozyfire Warranty work is carried out by ServiceForce and must be reported directly to ServiceForce and not Hamilton Gas Products Ltd.

Please note all goods supplied are stamped with month and year of manufacture.

CLAIMS for damage or shortage must be notified to ourselves in writing within 3 days of delivery. Non receipt of the whole or part of the consignment must be notified to Hamilton Gas Products Ltd within 7 days from date of dispatch. Claims outside these periods cannot be accepted. No responsibility can be accepted for damaged material or burst parcels on delivery unless Hamilton Gas Products Ltd are immediately notified by fax or phone. “Unchecked”, “Damaged” or “Shortage” will not be accepted by either Hamilton Gas Products Ltd or the chosen carrier(s).
